Terms of Service for Flovingo

1. INTRODUCTION AND ACCEPTANCE OF TERMS

Welcome to Flovingo ("App," "Service," "we," "us," "our," or "Company"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Flovingo regarding your use of our mobile application and all related services, features, and content.

By downloading, installing, accessing, or using Flovingo, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety. If you do not agree with any part of these Terms, you may not use the App.

These Terms apply to all users of Flovingo, including but not limited to users who access the App as registered users or guest users.

2. USER ELIGIBILITY

2.1 Age Requirement

You must be at least 13 years old to use Flovingo. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 13, you may not use this App.

2.2 Parental Consent

If you are between 13 and 18 years old, you represent that you have obtained parental or guardian consent to use Flovingo. Parents or guardians of minors are responsible for monitoring their child's use of the App.

2.3 Legal Capacity

You represent that you have the legal capacity to enter into this agreement and that using the App does not violate any applicable laws or regulations in your jurisdiction.

3. USER ACCOUNTS

3.1 Account Creation

To use certain features of Flovingo, you may create an account by providing an email address. Account creation is optional—you may use Flovingo as a guest user without creating an account.

3.2 Account Credentials

You are responsible for maintaining the confidentiality of any passwords or credentials used to access your account. You agree not to share your account credentials with any third party. You are solely responsible for all activity that occurs under your account, whether authorized or unauthorized.

3.3 Account Information

You agree to provide accurate, current, and complete information when creating or updating your account. You agree to promptly update your account information if it changes. You are responsible for the accuracy of all information you provide.

3.4 Account Termination

You may delete your account at any time through the app by navigating to Settings > Delete Account. You will be shown a confirmation dialog with a warning message. Once you confirm the deletion, all associated data will be permanently and completely removed immediately from both our servers and your device. The deletion process includes:

  • Immediate deletion of your account from our database
  • Automatic cascading deletion of all related data (user learnings, word learning history, preferences, etc.)
  • Clearing of all authentication tokens
  • Deletion of all local data stored on your device
  • Reset of all app state and preferences

No data will be retained - all information associated with your account will be permanently deleted with no exceptions. Once deleted, the data cannot be recovered. You can also request account deletion by contacting our support team. Flovingo reserves the right to suspend or terminate your account if you violate these Terms of Service.

4. ACCEPTABLE USE

4.1 Permitted Use

You agree to use Flovingo solely for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use and enjoyment of the App. Prohibited behavior includes:

  • Harassment, abuse, or threats directed at any person
  • Posting or transmitting illegal content
  • Attempting to gain unauthorized access to the App, our servers, or user accounts
  • Reverse engineering, decompiling, disassembling, or attempting to derive the source code of the App
  • Hacking, password mining, or any form of unauthorized access
  • Uploading or transmitting viruses, malware, or any code of a destructive nature
  • Spamming, phishing, or engaging in deceptive practices
  • Copying, reproducing, or distributing content from the App without authorization
  • Using automated tools, bots, or scripts to scrape or access the App
  • Any activity that impairs the functionality or security of the App

4.2 Monitoring and Enforcement

Flovingo reserves the right to monitor user activity to ensure compliance with these Terms. We may investigate any suspected violation and may take appropriate legal action, including account termination and reporting to relevant authorities.

5. INTELLECTUAL PROPERTY RIGHTS

5.1 Flovingo Content

All content within Flovingo, including but not limited to vocabulary lists, lessons, translations, explanations, graphics, logos, design elements, and all other materials, is the exclusive property of Flovingo and is protected by international copyright laws.

5.2 Limited License

Flovingo grants you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial learning purposes. This license does not permit you to:

  • Copy, modify, or create derivative works based on the App or its content
  • Distribute, sell, rent, lease, or sublicense the App or its content
  • Remove or alter any proprietary notices, labels, or marks
  • Use the App for any commercial purpose without explicit written permission

5.3 User Content

If you provide any content (such as usernames or feedback) through the App, you grant Flovingo a worldwide, perpetual, royalty-free license to use, reproduce, modify, and distribute such content for the purpose of improving and operating the App.

5.4 Copyright Infringement

If you believe that any content in Flovingo infringes your intellectual property rights, please contact us through Settings > Help & Feedback or email us at team@flovingo.com with details of the alleged infringement.

6. SUBSCRIPTION AND PAYMENT (FUTURE)

6.1 Subscription Plans

Flovingo may offer subscription plans in the future. If you purchase a subscription, you agree to pay the applicable fees as disclosed at the time of purchase.

6.2 Auto-Renewal

Subscriptions may renew automatically unless you cancel your subscription before the renewal date. You will be notified of any charges prior to renewal.

6.3 Cancellation

You may cancel your subscription at any time through the App settings or by contacting us via Help & Feedback. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial billing periods.

6.4 Payment Processing

Payment processing is handled by third-party payment processors. Your payment information is subject to the privacy policy and terms of the payment processor. Flovingo does not store your payment information directly.

6.5 Price Changes

Flovingo reserves the right to change subscription prices with 30 days' notice. Continued use of a paid subscription after price changes constitutes acceptance of the new price.

7. LIMITATION OF LIABILITY

7.1 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. FLOVINGO DOES NOT WARRANT THAT:

  • The App will meet your requirements
  • The App will be uninterrupted, error-free, or secure
  • Any defects in the App will be corrected
  • The App will be compatible with all devices or operating systems
  • The content is accurate, complete, or up-to-date

7.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLOVINGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or income
  • Loss of data or learning progress
  • Loss of use or functionality
  • Business interruption
  • Any other indirect or consequential damages

This limitation applies even if Flovingo has been advised of the possibility of such damages.

7.3 Maximum Liability

IN NO EVENT SHALL FLOVINGO'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO FLOVINGO IN THE PAST 12 MONTHS, OR $100 USD, WHICHEVER IS LESS.

8. MODIFICATIONS TO THE APP AND SERVICE

8.1 Right to Modify

Flovingo reserves the right to modify, suspend, or discontinue the App or any feature or functionality at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

8.2 Updates

Flovingo may release updates, patches, or new versions of the App. You agree to install updates as they become available to maintain security and functionality. Your continued use of the App following an update constitutes acceptance of the updated version.

8.3 Service Interruptions

Flovingo is not responsible for temporary or permanent interruptions in service due to maintenance, technical issues, server problems, or other factors beyond our reasonable control.

9. TERMINATION OF ACCESS

9.1 Termination by User

You may stop using Flovingo at any time. Deletion of your account constitutes termination of your use of the Service.

9.2 Termination by Flovingo

Flovingo reserves the right to terminate or suspend your access to the App immediately and without notice if you:

  • Violate these Terms of Service
  • Engage in illegal or harmful activity
  • Abuse other users or the Service
  • Attempt to gain unauthorized access to the App or our systems

9.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. You must cease all use of the App. Flovingo will delete your account and all associated data will be permanently and completely removed. No data will be retained after account termination.

10. PRIVACY AND DATA PROTECTION

Your use of Flovingo is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding data collection, use, and protection.

11. THIRD-PARTY SERVICES

Flovingo may integrate with or use third-party services, APIs, or libraries. Use of such third-party services is governed by their respective terms and conditions. Flovingo is not responsible for the functionality, availability, or policies of third-party services.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Flovingo, its founders, employees, agents, and representatives from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms of Service
  • Your violation of any applicable law or regulation
  • Your infringement of any intellectual property rights
  • Any content you provide or actions you take within the App

13. DISPUTE RESOLUTION

13.1 Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Turkmenistan, without regard to its conflict of law principles.

13.2 Dispute Resolution Process

If you have a dispute with Flovingo, you agree to attempt to resolve the matter informally by contacting us through Settings > Help & Feedback. We will attempt to resolve the dispute within 30 days.

13.3 Legal Proceedings

If the dispute cannot be resolved informally, you agree to submit to the exclusive jurisdiction of the courts of Turkmenistan for the resolution of any legal disputes.

14. CHANGES TO TERMS OF SERVICE

14.1 Modifications

Flovingo may modify these Terms of Service at any time. When we make material changes, we will notify users by updating the "Last Updated" date at the top of this document and/or by providing notice within the App.

14.2 Acceptance of Changes

Your continued use of Flovingo following the posting of revised Terms of Service means that you accept and agree to the changes. If you do not agree with the modified Terms, you must discontinue your use of the App.

16. SEVERABILITY

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

17. ENTIRE AGREEMENT

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Flovingo regarding your use of the App and supersede all prior negotiations, understandings, and agreements, whether written or oral.

18. NO WAIVER

Flovingo's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. If Flovingo waives enforcement of a particular provision, such waiver applies only to the specific instance and does not constitute a waiver of future enforcement.

19. SEVERABILITY AND SURVIVAL

The provisions of these Terms that by their nature should survive termination, including but not limited to intellectual property rights, limitation of liability, indemnification, and dispute resolution, shall survive termination of your use of the App.
