Terms of Service

These terms are the agreement between you and Flovingo (“we”, “us”) for using the Flovingo app and the website flovingo.com. By creating an account or using the app, you accept them. If you do not agree, please do not use Flovingo.

1. Who can use Flovingo

You must be at least 13 years old. If you are between 13 and 18, you need the permission of a parent or guardian, who accepts these terms for you. You must be able to enter into this agreement under the law that applies to you.

2. Your account

You sign in with your e-mail address and a code we send to it. Keep access to that e-mail address secure: whoever can read it can sign in to your account. You are responsible for what happens in your account. One account is for one person.

3. What Flovingo is

Flovingo is a speaking practice app. You answer questions out loud, listen to and repeat model answers, practise texts and words, and get feedback on your answers.

• The voices in the app are generated by AI.
• The review of your answers and some translations are written by AI. They can contain mistakes and are meant for practice, not as an assessment or a qualification.
• We cannot promise any particular result. How much your speaking improves depends on your practice.
• The app needs an internet connection for most of its features.

4. Free access period and subscription

• When you sign up, you get full access for 7 days. You do not need to enter payment details for this period. It is offered once per person, and we may refuse it where it is abused.
• After that, using the app requires a subscription, monthly or yearly, bought in the App Store or Google Play. The price is shown in the store before you pay.
• Subscriptions renew automatically until you cancel them in your App Store or Google Play account settings. A cancellation takes effect at the end of the period you have paid for.
• Payments, refunds and price changes are handled by the store you bought from, under its rules. Deleting your Flovingo account does not cancel a subscription.
• Without a subscription or other access, the app is locked, but your account, recordings and progress are kept. Subscribe or restore your purchase, and everything is available again.
• We may also give access for free or for a limited time — for example in a promotion or through a partner. Such access ends at the time we tell you, and we may withdraw it if these terms are broken.

5. Your content

Your recordings, the texts you add and the photos you scan remain yours. You allow us to store and process them — including through the service providers listed in our Privacy Policy — only to provide Flovingo to you: to transcribe and review your answers, read your texts aloud, translate them and read your scans.

Add only texts and photos you have the right to use. Do not add other people’s personal data or anything illegal, hateful or harmful.

6. Acceptable use

You agree not to:

• break the law, or harass, threaten or deceive anyone;
• get around the subscription, the free period or fair-use limits;
• access the service in an automated way — bots, scripts, scraping — or put an unreasonable load on it;
• try to access other people’s accounts or data, or our systems beyond what the app offers you;
• copy, sell or redistribute the app or its content, or reverse engineer the app, except where the law allows it;
• upload malware or anything that could damage the service.

7. Our content

The app, its lessons, texts, characters, audio, images and design belong to Flovingo or our licensors. We give you a personal, non-exclusive, non-transferable licence to use them in the app for your own learning. This licence ends when your access ends.

If you send us ideas or feedback, we may use them freely, without any obligation to you.

8. Changes and availability

We keep improving Flovingo, so features and content can change, be added or be removed. We work to keep the service available, but it can be interrupted for maintenance or by problems outside our control, and we do not promise that it will always be available or free of errors.

9. Ending

You can stop using Flovingo at any time and delete your account in the app (Settings → Delete account and recordings). We may suspend or close an account that breaks these terms or the law; where reasonable, we will tell you why first. Sections 7 and 10 to 13 continue to apply after an account is closed.

10. Disclaimer

Flovingo is provided “as is” and “as available”. To the extent the law allows, we make no warranties of any kind, express or implied, including that the app will meet your needs, be uninterrupted or error-free, or that AI-written content will be accurate.

11. Limitation of liability

To the extent the law allows, Flovingo is not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or progress. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim, or 100 US dollars, whichever is less. Nothing in these terms limits liability that the law does not allow to be limited.

12. Indemnity

If someone makes a claim against us because of your content, your breach of these terms or your breach of the law, you agree to cover the reasonable costs and losses that result, to the extent the law allows.

13. Governing law and disputes

These terms are governed by the laws of Turkmenistan. If you have a problem, write to us first at team@flovingo.com; we will try to solve it within 30 days. If we cannot, the dispute will be decided by the courts of Turkmenistan, unless the law of your country gives you the right to bring it elsewhere.

14. App stores

These terms are between you and Flovingo, not Apple or Google, and the stores are not responsible for the app or its content. If you got the app from the App Store, Apple’s Licensed Application End User Licence Agreement also applies to your use of it.

15. Changes to these terms

When we change these terms, we update the date at the top. If a change is significant, we will tell you in the app or by e-mail before it applies. If you continue to use Flovingo after that, the new terms apply; if you do not agree, you can stop using it and delete your account.

16. General

If a part of these terms cannot be enforced, the rest still applies. If we do not enforce a right, we do not give it up. These terms and the Privacy Policy are the whole agreement between you and us about Flovingo.
